Chapter 7
Chapter 7 bankruptcy, also known as “liquidation” is generally a faster and less expensive manner of obtaining a fresh start. If one qualifies to file Chapter 7, a discharge is normally issued in a few months from the time of filing. However, not every debt is dischargeable in a Chapter 7 and not everyone qualifies to file Chapter 7 bankruptcy. In a Chapter 7, an appointed Trustee will liquidate any non-exempt assets that the debtor may own and distribute the proceeds to the creditors. Therefore, it is extremely important that you consult with an attorney, who is familiar with both Chapter 7 and 13, so that your petition is prepared and filed properly.

Chapter 13
Chapter 13 bankruptcy does provide some protections and benefits that Chapter 7 does not, such as cram-down and lien stripping. Although it may take a while to complete a Chapter 13 plan and the debtor will have to make payments to the Chapter 13 Trustee for a period of time, it may be a wise choice or the only option for many people.
